1. Acceptance of Terms
By accessing or using the Canopex service ("Service"), operated by JabLab ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Canopex is a geospatial analysis platform that processes KML/KMZ files to deliver satellite imagery analysis including NDVI vegetation indices, weather correlation, and AI-powered insights. The Service is currently in early access and provided as-is.
3. Eligibility
You must be at least 18 years old to use the Service. By using Canopex, you represent that you meet this requirement.
4. User Accounts
When account functionality is available, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorised use.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious files or attempt to exploit the Service
- Interfere with the operation of the Service or other users' access
- Attempt to reverse-engineer the Service beyond what open-source licences permit
- Exceed reasonable usage limits (e.g., automated bulk submissions)
6. Your Data
You retain ownership of any KML/KMZ files and data you upload. We process your data solely to provide the Service. See our Privacy Policy for details on data handling and retention.
7. Intellectual Property
The Canopex software is open source under the Apache License 2.0. The Service infrastructure, branding, and website content remain our intellectual property.
Satellite imagery returned by the Service is sourced from third-party providers (e.g., Microsoft Planetary Computer) and is subject to their respective licences.
8. Service Availability
We aim to keep Canopex available but make no guarantees of uptime, especially during early access. We may modify, suspend, or discontinue the Service at any time without notice.
9. Paid Subscriptions
Paid plans (Pro, Team, Enterprise) are billed monthly or annually via Stripe. By subscribing you agree to:
- Recurring billing: Your chosen payment method will be charged automatically each billing cycle until you cancel.
- VAT: Value Added Tax is calculated and collected at checkout based on your billing address, in accordance with UK HMRC regulations. VAT invoices are available in your billing portal.
- Price changes: We may adjust pricing with at least 30 days' notice. Existing subscriptions continue at the current rate until the next renewal after the change takes effect.
10. Cancellation and Refunds
- 14-day cooling-off: Under the Consumer Contracts Regulations 2013, you may cancel a new subscription within 14 days of purchase for a full refund, provided you have not used more than 5 pipeline runs during that period.
- Self-service cancellation: You may cancel your subscription at any time from the billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
- No partial refunds: Outside the 14-day cooling-off period, we do not offer partial refunds for unused portions of a billing cycle.
- Failed payments: If a payment fails, we will retry according to Stripe's retry schedule. After repeated failures, your subscription may be downgraded to the Free tier.
11. Limitation of Liability
To the maximum extent permitted by law, Canopex and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind.
12. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will indicate the "Last updated" date at the top of this page.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
